The Ecological Compensation Legal System Research

The ecological environment not only provide the material for human’s live, but also offer inexhaustible economy to social development.For a long time, human has a blinding mind to conquer nature and use of resource which is harmful to ecological environment’s self-cleaning. Ecological compensation system was born and set up by a process which is in search of dealing with these bad conditions. As an important area of ecology, economics, law and sustainable development fields system, ecological compensation system has been attached importance to the governments around the world and has been put into practice. Jurists have different statements on this issue and there is no unified concept yet. From the views of judicial practice, more consistent recognition is that: ecological compensation system is based on the purpose of conservation and sustainable use of ecological services, mainly by economic means, and regulates the relevant interests’s arrangements. In the European Union legal system, the laws relate environmental protection, occupy an important position, especially for agricultural production, Ecological landscape protection and so on. They have formed a completed system. Drawing on European Union’experience on ecological compensation system will improve China’s ecological compensation in the initial stages and the legislative practice. In this article, I use the actual situation of the European Union ecological environment as a starting point.From the perspective of law, improved legislation and mature theoretical support is the key to success. The research on ecological compensation system on European Union should form a unified, systematic theory. By analyzing the individual cases and summarizing their internal systems theory and successful practice experiences, it should be the useful way to urge the ecological compensation system in China and improve the legislation and practice development.
