Food safety issues related to the root of people’s livelihood. Food safety is a standard test of national public management capabilities, also reflects the people’s happiness index key, so is always the focus of attention of the Government and people. In recent years, China’s food security situation is worrying, a series of food safety events to the people and the government suffered a heavy blow, and as soon as possible to improve the research in the field of food safety is a priority. Food Safety covered many areas, this paper, starting from the core issue of food safety supervision to a legal point of view to analyze problems in food safety supervision.This paper first introduces the theoretical basis of China’s food safety regulation and the status quo, through the analysis of the status quo of China’s food safety, and explore China’s food regulatory problem is the legal basis for the lack of food safety supervision. Food safety supervision and supporting systems are not perfect; food safety regulatory system is not perfect; food safety accountability mechanism is implemented completely. The reason for these problems is the Administrative Organization Act lag, the slow food standards development and clean-up; traceability system and recall system is not the formation of the system and scale; regulatory mode unscientific, lack of regulation and law enforcement performance appraisal, lack of social supervision and industry supervision; implementation of the accountability mechanisms in place, judicial accountability out of touch and other reasons. Foreign food safety supervision earlier, this paper introduces the theory and practical experience in the United States and the European Union, to provide some references and to solve problems in China’s regulatory.Finally, combining foreign advanced experience of China’s regulatory issues can be perfect, from the following aspects:First, improving the legal basis for the improvement of the administrative organization law and food safety standards is the key. The second is to improve coordinated regulatory system, starting from the traceability system and recall system to perfect. The third is to improve the food safety regulatory system, such as changing the rigid main body of the regulatory approach and clear the Food Safety Commission, the standard of food safety as a performance appraisal, social and industry oversight. The fourth is to strengthen accountability mechanisms, which must strengthen the implementation of administrative accountability and judicial responsibility.
