The Defects Of Legal System Of Construction Engineering And Countermeasures In China

Our engineering legal system is improving constantly with the rapid development of legal system process, but the perfection of legal system is not achieved overnight, the construction project of the current legal system still has lots of problems. The behavior of the whole construction process should be regulated by law, all the each main stage and main link of the main stage of the engineering construction should be covered by the content of the law. At present, our current legal system is still failed to its comprehensive coverage.This paper shall comb the current legal system construction project from two aspects of the horizontal structure and longitudinal structure. The horizontal structure is mainly refers to the whole construction period of the engineering construction project covered by the law, and the vertical structure is mainly refers to the form and the effectiveness of the hierarchy of the law according to Legislation Law of the People’s Republic of China. Then the basic framework of our existing legal system construction project will be sorted out, and establishment legal system of the construction project embodied in perfect construction project legal relationship will be pointed out, and the important significance of perfecting a construction project legal system will be put forward in this article.Firstly,this paper will analyze the existing legal system from the process and the content of project management to find out the vacancies of current system, and put forward the content will still be perfected; Secondly, the internal contradictions are mainly embodied in the conflict among laws, model contract forms of projects and internal defects of legal system will be show clearly through specific example analyses; Finally, this text will give the features of a sound legal system construction project, and indicate the measures to project the pretty well-established construction legal system.
