On March15,2006, the United Nations General Assembly voted overwhelmingly the resolution60/251, decided to create a new United Nations Human Rights Council with a mandate to address human rights situations in the United Nations systems, including gross and systematic human rights violations. On19June2006, the first meeting of the Human Rights Council was convened in Geneva, Switzerland, abolished the United Human Rights Commission which has60years history, and a new United Nations Human Rights Council with a mandate to address human rights situations in the United Nations systems started to work. The United Nations Human Rights Council had convened16sessions and15special sessions by25March2011。For the United Nations Human Rights Council was still in its primary stage, the scholars did not studied enough further on the Human Rights Council from the international institutional law, the author want to perspective on the United Nations Human Rights Council from the international institutional law.This thesis has six chapters together, and it starts from a brief introduce of the research’s background and significance, the domestic and abroad research’s situations, the methods of research and the innovations of this thesis. In the second chapter, the author outlines the Commission on Human Rights. The third chapter focuses on the legal framework of the United Nations Human Rights Council, the purposes and of the United Nations Human Rights Council, the legal status of the United Nations Human Rights Council, the memberships of the United Nations Human Rights Council, the functions of the United Nations Human Rights Council, and the rules procedure of the United Nations Human Rights Council, including sessions(regular session and special session), participation of and consultation with observers of the council, organization of work and agenda for regular sessions, president and vice-presidents, secretariat, records and report, public and private meetings of the Human Right Council, conduct of business, etc. In chapter four, the author introduces the Human Right Council’s successions and innovations of the Commission on Human Rights. The author reviews the success of the United Nations Human Rights Council from International human rights legislation and International human rights protection system (the universal periodic review mechanism), point out the problems facing the United Nations Human Rights Council and the prospects of the United Nations Human Rights Council in the fifth chapter. The author discusses the influence between the United Nations Human Rights Council and China in chapter six. In the last chapter, the author tries to research the significance of the establishment of the United Nations Human Rights Council on the international institutional law.
