| Because current medical dispute resolution mechanism is the existence of some defects,themedical dispute cannot be resolved quickly and effectively.Because of the advantage ofconvenience,economy,swiftness,profession and so on,ADR finally becomes the tendency ofresolving the medical dispute in many countries and areas.Indor to better resolve doctor-patientconflicts and effectively solve the medical dispute,the thesis analyzes existing medical disputemechanism,and advanced experience of the construction of Chinese medical disputes,and putsforward the way to ADR obtains the new challenges of medical disputes,adapt to socialdevelopment.This article is divided into the following sections:The first part is an overview of medical disputes, first discusses the meaning ofmedical disputes, highlighting the causes of the classification of medical disputes andmedical disputes.The second part of medical disputes, non-litigation mechanism legislative visits,respectively, introduced the United States, Japan, Germany, and China’s Taiwanregion, non-litigation of medical dispute resolution mechanisms, and finally byanalyzing their similarities and differences between countries and regions ofnon-litigation mechanism evaluation.The third part through the present stage of medical disputes settlement mechanism,the learn from the experience of other countries on the basis of a non-litigationimprove our medical dispute settlement mechanism several suggestions, including theimprovement of the medical dispute legislation, norms Medical Dispute mechanism,the establishment of relevant institutions, the establishment of medical liabilityinsurance system, improve the mechanism of negotiated settlement, the developmentof people’s mediation of medical disputes and the establishment of a medical disputearbitration institution.
