Concerning The Civil Mediation System About Liangshan Yi In Transition Period

Liangshan Yi area is a large number of China’s minority groups. In recent years, the Liangshan Yi attracted the attention of many scholars because of its special jiazhi system, the old rules of customary, the form of dugu mediation to resolve disputes and so on. Jiazhi, customary law, Dugu, civil mediation is not an independent concept.They are mutually implicated in each other’s existence, depend on each other, influence each other, and formimg the Liangshan Yi people’s lives, production, and marriage all aspects of social background. However, with our country’s reform and opening up, the impact of the market economy, foreign cultural invasion, Liangshan Yi are rapidly entering the transition period. Economic or cultural are facing intense impact of traditional and binary. This study focuse on civil mediation, customary law, Jiazhi, kinship.It will Research how the Ethnic Folk mediation will operate, How it will interact with the national judicial, How the civil mediation will be included to the formal or semi-official national judicial field, How to solve the existence of Degu.This article is divided into four part. The first part is the part of minority civil mediation theory.In this part, I will mainly introducethe basic civil mediation, specily about of ancient mediation characteristics of the ancient process of mediation.The second part I will focus on the transition period in Liangshan Yi about the changes of civil mediation system. In the third part I will study the economic development and social change in Liangshan Yi. Exploreing the environment of the Liangshan Yi customary law and civil mediation.The last part I will mainly study the path of civil mediation system in the process of social transformation in the Liangshan Yi area.
