Legal Analysis On The Environment Responsibility Of Enterprise Under The Background Of Low Carbon Economy

Human activities since the industrial revolution, especially the largeconsuming energy resources during the process of industrialization in the developedcountries,have a significant impact on global natural ecological system and bringchallenges to the survival and development of human society.But nowadays, globalwarming is becoming one of the most far-reaching environmental issues in theworld.China, as a major greenhouse gases emission country, is facing increasinginternational public pressures.Low carbon economy, with it’s own characteristics of “low consumption, lowpollution, low emissions”,was explored as a new development model by humanbeings under the circumstance of the seriousness of global warming.Low carboneconomy is a cleaner production pattern as well as an inevitable choice for countriesall over the world. Enterprises, as the main subjects of environmental responsibilities,should wisely chose low carbon economy as their developing ways,either in respectof positively fulfillment of their environmental responsibilities or it’s own adjustmentof the current and future development of economical level.This article mainly study two aspects: the legal analysis of corporate ecologicalresponsibilities under the background of low carbon economy and the fulfillmentmethods of corporate ecological responsibilities under the background of lowcarbon.Basic concepts are to be set forth with the understanding of low carboneconomy, and the concept, characteristics and basic requirements of the corporateecological responsibilities.By analyzing the legitimacy of the expanded corporateecological responsibilities, we can prove the necessity and possibility of emphasizingthe corporate ecological responsibilities under the trend of low carbon economy.Then we can appreciate the research value of this article. By re-thinking andre-constructing the “legal person model “, this article mainly advocate thatenterprises turn from “economic man” to “ecological man”, then discuss thefulfillment methods of corporate ecological responsibilities under the background oflow carbon economy. These methods including formulating unified enterpriseenvironmental liability law,establishing constitutional status of civil environmentright, improving the environmental public litigation system,perfecting the legal surveillance mechanism, etc. This surveillance mechanism shall be leaded thegovernment, participated by the social subjects and the general publics and supportedby the enterprises.The author of this paper hope the legal analysis can provide legal theoreticalsupport when establishing the system of environmental responsibility in our countryand make the legal system more ecological, adapt to a low carbon economy, thuspromoting social harmony and sustainable development of China in the future.
