On The Legal Protection Of Network Privacy Right

With the development of computer and internet technology, the humankind enters a diversity world, enjoying all kinds of information. But coin has two sides, the Network technology challenging us social and civil government as its convenience.At present, the personal data from unauthorized collection, storage, use and dissemination of common occurrences, personal privacy is compromised and the Internet has been violated when the event occurred. The online privacy Infringement, a prominent social problem has taken the community’s concern.The present law and judicial procedures has no regulation to protect the interests of internet users, so it calls for improvement of our legal system, to protect the online privacy.This article includes four parts:the first part of the network introduced the concept of internet privacy, lists the existing international network of privacy protection of the three protected mode, the U.S. industry self-regulation model, and second mode of the Legislation of the European Union, three of Japan’s self-control mode, and analysis our legislation protection of privacy in the network. The second part analyzes the performance and characteristics of network forms of privacy infringement. The third part focus on the analyze of the elements of the privacy on internet, made difference between the reality of privacy and Internet privacy.The purpose of this article is through the analysis of specific network privacy infringement cases, explore the network and the corresponding need for privacy protection measures, protection of privacy for our network of legislative proposals put forward feasible, provide a reference for the legislature next legislature.
