There is only a scarce resource exchange value,it becomes a commodity.The environmental capacity of the emissions as the carrier has a valueattribute because of the limited capacity of the environment and the scarcity ofenvironmental resources, Environment is multi-functional and the value ofdiversity.Environmental capacity is a function of environmental values. Theessence of the carbon emissions right to environmental resources, is anintangible property rights as well as emissions trading market is the right of themain object of the environmental capacity of the environmental elements of theright to use."Kyoto Protocol" has spawned the carbon emissions trading market.Statistics show that carbon trading could replace oil as the world’s largestcommodities trading. China has not construct itslegal system on carbonemissions trading yet a. In order to speed up the establishment of China’scarbon emissions trading market and should be a carbon emissions tradingfrom the regulatory policy level to the legal level to be determined.The contents can be divided into five parts:The first chapter is the introduction part of the full text of the main topicsaddressed in the background of "United Nations Convention on Climate Change" andthe conclusion of the Protocol raises the issue of carbon emissions trading. SecondFive-Year plan, China should accelerate the establishment of proposed carbonemissions trading market requirements. China has established more than100environmental exchanges market which is not unified national laws to regulate,therefore,it is necessary to introduce China’s relevant laws to guide the developmentof this emerging market.The second chapter discusses the theory of carbon emissions trading,including the theoretical source of carbon emissions trading as well as definingthe legal feature of carbon emissions trading. At last, we illustrated the carbonemissions possesses the property right, but a restricted property.The third chapter will explain the subject and object of carbon emissionstrading.In addition, we point out some regulations and behaviors of carbonemissions trading system in following aspects.The fourth chapter mainly introduces the Kyoto Protocol, which is thebasis of the carbon emissions trading basis in international law. It isconsidered that the legal document Kyoto Protocol makes carbon emissionstrading markets emergence and development. This chapter will focus on thecontents of the Kyoto Protocol introduced and the disadvantage of the KyotoProtocol.The fifth chapter discusses the current conditions of Chinese carbonemissions trading system and the legal construction in future. It concludes thatour country should take some measures such as the distribution system,thecarbon emissions trading license system and the certified supervision systemunder the premise of total control, according to our national specific situation.
