Research On The Reform Of Food Safety Legal System Of China

This article proposed the idea of perfecting food safety laws and regulations system ofChina and specific paths and solutions by comparing international food safety laws andregulations system with that of China, using literature, normative analysis, comparativeanalysis and empirical research and so on. The main research results were as follow:(1) In theory, food safety laws and regulations of China which include comprehensivefood safety and special laws and regulations, covering the raw materials production andprocessing and circulation etc. Although it contains all of the process, there are main defeatsin the actual operation: Food safety laws and regulations system of China which lack ofcoordination and operability overlap; It is difficult for food safety laws and regulations ofChina to adapt to the needs of food security situation; Also food safety laws and regulationssystem of China is not sound and there are some blind spots and holes; The protection ofcriminal law for food safety is not enough; It remains to be further strengthened forinformation transparency and communication.(2) We should draw lessons from experience of Britain, the United States, Germany,Japan and other countries, practicing the “from farm to table”whole regulation of nationalfood safety regulatory system and food safety report reward system. Meanwhile we mustincrease the intensity of food safety law responsibility, strengthen supervision coordinationmechanism and practice an unified food security information release system.(3) We also should adhere to the four principles: the principle of information open andtransparent, full regulatory, risk assessment analysis and security responsibilities clearprinciple. The main measures to curb food safety accident is to improve China’s food safetymarket access threshold and stand to the categorized management. Institute food productionlicense management referring to drug production supervision approval process in the foodsafety accident prone areas. We still have to set up the only national food safety standard,cancel local food safety standards, establish a clear division of responsibilities of food safetysupervision and food safety traceability and recall system.
