Human’s Harmonious And Free Development In China Construction Of Rule By Law

The eternal theme in human history is the development of people, which is notonly a philosophical problem, but also a practical issue. In the process of constantdevelopment, people have been thinking about what a kind of life humans should live toachieve their development. As an achievement of human civilization, nowadays, therule of law has become an important way of life and a realized approach of humandevelopment as well. Running state affairs according to law is determined as our basicstrategy of administering the country on the15thNational Congress of the CPC. Withthe guidance of the Scientific Outlook on Development, our socialist legal constructionpersists in ‘Human-centeredness’, promoting and ensuring the humans’ development.The humans’ development is historical and specific. At present, our country is in aperiod of social transition when great changes have taken place in all fields, meanwhile,with many contradictions and conflicts emerging. Harmony with differences is aharmonious unify and a free developing condition for everyone. Under the backgroundof constructing harmonious society with our efforts, human development should be freeand harmonious in the course of building our legal system. At the same time, centeredon harmonious freedom, the socialist legal system promotes and safeguards people todevelop freely and harmoniously. However, our country is still at the primary stage ofsocialism. Market economy is so insufficient that it leads to the society’s immaturity.Moreover, due to the negative influence of traditional rule of law and unsubstantialconstruction in legal spirit culture, lots of problems have appeared in our country, suchas, lack of human’s subjectivity, damaged civil rights by incomplete legal operation,insufficient protection of human rights and deficiency in citizens’ legal belief and so on.Therefore we should establish a ‘Human-centeredness’ developing mode of rule of lawand improve legal system by which the social relations can be adjusted to make thesociety harmonious and stable. In addition, we should also establish and perfect theprotection system of human rights and the ‘three systems’ in order to provide assurancefor the humans’ free and harmonious development of human in the legal construction.Furthermore, we are supposed to cultivate citizens’ legal belief to maintain our owndevelopment.
