There are two sides to the social impact of the commercialization of GM crops. Oneside is great economic and social interest, the other side is the potential and unpredictablerisk. Both positive and negative social impact is a direct reason for heated social debate;an underlying reason is the battle of interests from different interested participants.Specifically, In the process of commercialization of GM crops, there are interestedparticipants who always try to maintain existing interest, or avoid future risk throughvarious means of influencing the formulation of policy. In this process, the role of law is tocoordinate interests, in order to guarantee the distribution of benefits and risk assessmentmeet the quest of fairness and justice. Law has a positive impact on society by regulatingand controlling interests. Actually, legal relationship is a type of relationship of interests.The process of legislation is to distribute interests. The legislation, as a precondition of theoperation of law, is not only a codification of law, but also a dynamic process ofdistributing interests. And the design and arrangement of legislative procedures has aneffect on law’s functions. So the procedure of legislation is one vital factor toimplementing law’s function. In my article, I analyze the deep-seated social impact ofcommercialization of GM crops: which is the impact of social structure and democracy;and interpret the power game from participants differing interests. This power game existsin the many of the relationships of various interests. Then from a legislative point of view,I analyze the power game between Expert Decision-making and Public Participation. Thetraditional mode of political decision-making is the mode of Expert Decision-making,which excludes the publics, especially in science and technology policy-making. Howeverwith the loosening of scientific authority and the absence of public trust, the legality ofpolicy decision about science and technology is being questioned. The way of solving thisproblem is to introduce more democracy, more openness, more responsibility and morepublic participation in the scientific field. The law should confirm the right of publicparticipation, and furnish the procedural safeguards for the exercise of that right; as thesame time, law should provide a platform for the game between Expert Decision-makingand Public Participation, in order to guarantee policy decision meet the interest orwell-being of human.
