Dilemma And Possible Solutions: The Perfection Of Service System In Chinese Civil Law

Service is one of the primary procedures in Chinese civil litigation, which penetratesthroughout the whole civil litigation procedure and affects the process of civil litigation aswell. Therefore, to establish a workable and reasonable mechanism of Service is of greatimportance to ensure the fairness and efficiency in civil litigation. Notwithstanding, for along time, Service in civil law is not fully respected due to the fact that we can not correctlyfind a balance between substantial civil law and procedure civil law. Furthermore, thelegislation on Service is not detailed and practical, which causes many problems in judicialpractice. The difficulties on Service of legal documents severely disturb the normallitigation procedure in Chinese civil court and is not able to protect the rights and interestsof the parties in a civil litigation as well. Hence, it is of urgency and necessity to makecertain improvements on civil Service procedure at this moment. This paper, throughanalyzing the present civil Service cases in Chinese civil law practice and some difficultieson Service in civil procedure, tries to find possible solutions on the improvements andperfection on Service system in Chinese civil law.
