A Study On The Value And Realization Of The Equality Of Suffrage Of Chinese Citizen

The fifth amendment of current Election Law in2010established that the deputy tothe people’s congress elected by rural citizen represents the same number of people as thedeputy to the people’s congress elected by urban citizen. This establishment means theequality of suffrage, it plays an energetic role in the complete of China socialismdemocracy and government by law. However, the provision of law can not guarantee therealization of the equality of suffrage in practice, in order to ensure this realizationbecome true, we still need to do some institutional arrangement.This paper consists of four parts.Part1reviews the legislation on election in China. It firstly illustrates the concept ofsuffrage. Then, the equal election by citizen is defined. Furthermore, it gives a retrospectto the legislative stipulation of the changes of election proportion of the deputy in ChinaElection Law.Part2states the value of the equality of suffrage by urban and rural citizen. Equalsuffrage enjoyed by urban and rural citizen means the bridge of the gap between urbancitizen and rural citizen and the self-determination of Chinese farmers. Besides, equalsuffrage can also guarantees the equality of citizen’s education, economy, culture andother rights.Part3analyzes the legislation and practice of equal suffrage in some westerndemocratic countries. The legislation process of the equality of suffrage by citizen in U.K,U.S.A and France is mainly discussed. The practice process of the equality of suffrage bycitizen in U.K has been studied from3different angles, and based on these studies, someenlightenment has been obtained.Part4proposes some routes for the realization of equal suffrage enjoyed by urbanand rural citizen in China,mostly ensure the full realization of equal suffrage of citizens, including:1on the basis of amendment of the Election Law, we need to continue improvethe Election Law, such as adding the provision of suffrage of the floating population andthe measure of professionalization of the deputy into the new Election Law;2make upthe mechanism for citizen’s participation into politic through creating new institution forcitizen to take part in politics;3by raising the awareness of right to promote the positiveparticipation of citizen into election and other political activities;4start the judicial reliefchannel, take the judicial force as the secure for achieving the equality of suffrage.
