The Research On The Risk Assessment&Warning Mechanism Of Public Prosecution

In early2010,“The Supreme People’s Procuratorate’ ImplementationAdvice On The In-depth Reform Of The Social Contradiction Defuse，SocialManagement Innovation, Impartial And Honest Law Enforcement "putforward specific demands on the risk assessment&warning mechanisms toestablish and improve the law enforcement investigators. In recent years, theprocuratorial organs have actively established risk assessment&warningmechanisms of law enforcement investigators,and achieved certain results,but more executive fouced on procuratorial organs Kongshen department. Asan important functional department, Public Prosecution Service play animportant role in three priorities of further promote the social contradictiondefuse，social management innovation, impartial and honest law enforcement.It’s imperative and the urgent need of the situation to establish the riskassessment&warning mechanism in Prosecution lines to strengthen earlywarning and risk control, improve the quality and effect of case handling. Inthis context, this article researched the situation of the risk assessment&warning mechanisms of law enforcement investigators around China,evaluated the research results of other scholars and layed a solid theoreticalfoundation, introduced the basic concept of the Risk Management, and triedto give a design of the risk assessment&warning mechanism of publicprosecution and supporting machanism combined with the actual situation.This paper is divided into four parts, the first part is to use thecomparison analytic method to clarify the basic concepts, introduce the basicconcept of the Risk Management and clear the basic idea of risk management—prior prevention;the second part is to use the empirical analytic method toresearch the historical background and necessity for establishing themechanism and the practice effectiveness procuratorial organs all over thecountry; the third part is to create the basic framework of the mechanism,from the point of confirmation of subject, object, risk point, risk level,thetime of assessment, warning report and so on; the fourth part is to design thesupporting machanism with information communication, joint action toinvestigate, arrest and prosecute, prosecutor resource allocation, publicopinion response and so on..
