Frontier Administrative Inspection

For a long time, the study on law character and basic principles of frontierinspection is deficient,which prevent the frontier adminstrative inspectionfrom developing well. In this paper, under the guidance of the theory ofadministrative law, the writer analizes the concept and characteristics also thelegal nature of frontier adminstrative inspection, come to that frontieradministrative inspection is the behavior of that frontier inspection authorityinspect people and transports to keep exit&entry in order according to thelaws; frontier administrative inspection is different from administrativelicensing and administrative penalty and its legal nature is administrative realbehavior. On this basis, the author further analizes the classification offrontier adminstrative inspection, as well as to explore the application of theprinciple, come to that both self-governed inspection and assistanceinspection should abide the basic pricinples of adminstative law: lawprecedence，law reservation and proportion principle. The writer’s conclusionis valuable to help people understand law’s character of frontieradministrative inspection and to advance the frontier administrtive inspectionto be legalization.
