The legal concept of Marx and Engels is an integral part of basic theory of Marxism. It is also the theoretical basis of legal theory of socialism with Chinese characteristics. It’s basic ideas and details can be found among the works of each period. This thesis will list these scattered thoughts and perspectives together systematically to clarify contents of Marx and Engels" s legal concept.Marx and Engels presented their nation and law theory in "German Ideology", then, Marx and Engels analyzed and exposed the class nature and characteristics of law in the "Communist Manifesto" published in1848with historical materialism worldview, and described characteristics of its legal theory. Marx and Engels also found that the law is rooted in the course of the economic campaign. Marxist analyzed the economic basis of law in the "Capital". Engel discusses the nature and relative independence of the law comprehensively and profoundly, and explain the law’s own movement to further develop and improve the concept of law. Marx and Engels’s legal concept holds that the mode of production of material production plays a decisive role on the development of the law; law is the national will increased from the class will; law has a certain independence nature, its development, changes are in historical inheritance nature, and are effected by other superstructure.Other Marxists followed Marx and Engels inherited and developed the legal concept. Western scholars of Marxism and some British and American scholars created the legal concept of Western Marxism. In the Soviet Union, the legal concept of Marx and Engels is reflected in Lenin’s view on the law. His legal thinking is critical, practical and innovative. In China, the legal concept of Marx and Engels evolved into Mao Zedong’s "legal concept of Deng Xiaoping’s "legal concept of Jiang Zemin’s "Rule of Law" and Hu Jintao’s "socialist concept of law.
