Discussing On1Ega1System Of Community Correction In China

Community correction is the execution opposite to prison correction. The offenders suitable for this method are placed in community by special state organs to correct their criminal mind and bad behavioral habits in the period decided by court decision, judge or decision, with the assistance of relative societies and civil organizations and volunteers. Community correction in the U.K. and the USA has developed to a relatively mature stage. By contrast, community correction in our country appeared late, and related legal system has just started. There are lots of common problems in the practice of community correction. The power of the executive subject is too weak; they are flaws in the procedure; the legal supervision mechanism is not perfect; the legal system is not sound; etc. These all influenced the effect of the correction of the criminals and the execution of the punishment. In order to solve these problems, we need both to explore our own way and learn the advanced foreign experience, so as to build our police force to strengthen the power of the executive subject, we need to complete the procedure, we need to improve the legal supervision mechanism, we need to add community service sanction to our Criminal Law, and we need to make a special Community Correction Law, complementary legal regulations, implemental details with local characteristics and complete our relative legal system, in order to promote the development and perfection of our community correction system.
