The Legislate Research On The Construction And Management Of Urban River In Hangzhou

As the key component of urban ecosystem, urban river has not only the functions of providing water, transportation shipping, flood protection and waterlogging drainage,but also has the important ecological value including adjusting the climate, cutting down pollution and so on. However, in the process of rapid urbanization, the artificial occupy of the urban river, the continuity limit of the river with transgresive ecological corridor, the river water quality deterioration and the damage towards natural ecological system, all lead to a severe loss of the function of urban river. Developed countries has paid attention to urban river environmental issues at an earlier time, in their river regulation process, developed countries accumulated some experience, and also made achievements. In recent years, environmental problems of rivers has aroused the attention of many cities in China, and large scale integrative governance actions are initiated, Hangzhou is one of them. However, because the project of urban river construction and management lacks strong targeted legal basis and legislative guarantee, the results have been affected. According to the domestic and overseas river management experience, strengthen lawmaking, and then regulate rivers in accordance with the law, is a necessary approach to make urban river construction and management project reach a high standard goal. As a result, stepping up efforts to formulate relevant legal regulations for Hangzhou urban river construction and management is on the agenda. Based on this, this paper put forward the structuring of the legislation framework of Hangzhou urban river construction and management, discussing and exploring it separately from three aspects as legislation idea, management system and legal system.This paper takes Hangzhou urban river construction and management legal relationship as the research object, starting from the concept definition of urban river, and the analysis of urban river characteristics. Then on the basis of current situation of Hangzhou urban river construction and management legislation, this paper summarizes the domestic and overseas legislative experience of river (or urban river) construction and management, and provide reference for the legislation from the aspects of legislation idea, management system and legal system. Finally, this paper proposes the legislative suggestion on how to formulate the legal regulations of Hangzhou urban river construction and management:firstly, tries to build the new overall framework for Hangzhou urban river construction and management legal regulations, and then, put forward some targeted and operational policy suggestions on the legislation idea, management system and legal system, and also do theoretical demonstrations for some innovative ideas. This paper aims to provide useful explorations and suggestions for the establishment and perfection of Hangzhou urban river construction and management legal regulations.
