River Chief System Local Special Legislation Research In Fujian Province

River Chief System refers to the system in which River Chiefs organize and coordinate the responsibilities of relevant functional departments,manage and protect the water environment through target decomposition and hierarchical transmission,and guarantee the operations with strict evaluation mechanism.It originated from Wuxi,Jiangsu Province,in 2007 as a solution to the "Tai hu cyanobacteria incident".Because of the unique effect of this system in river protection,it was then promoted in the whole Jiangsu Province.The guidelines published by Chinese central authorities in December 2016 means that the system has been confirmed at national level.In 2017,the revised Water Pollution Prevention Law stipulated the River Chief System,which would provide the legal basis for it.Since then,the system to national rapid development.As a pilot national ecological zone,Fujian is one of provinces which early explore the River Chief System,and attaches great importance to the protection of water resources and the governance of rivers.However,due to the absence of specific laws,there are still some legal problems in practice,such as unclear authority of river chiefs,inadequate supervision and accountability mechanism,and unsmooth public participation mechanism,which hinder their comprehensive implementation and need to be solved through legislation.This article first elaborated the legal dilemma when Fujian implemented the River Chief System.The second part demonstrates the necessity and feasibility of establishing local regulations of River Chief System in Fujian Province.In terms of the necessity,it is demonstrated from two levels: the need for the system to change from scattered legislation to special legislation,and the need for it to change from the policy to law.As far as feasibility is concerned,the promotion of local special legislation not only has the support of laws and policies at the national level,but also has the experience of other provinces for reference.At the same time,it can draw valuable experience from the existing practice in Fujian Province.Finally,the author puts forward some concrete suggestions on Fujian local special legislation of River Chief System.First,giving advice to the name of the local regulations of the River Chief System of Fujian Province.Secondly,according to the implementation of the Fujian Province and the existing legal problems,the author puts forward suggestions on the framework of the regulation.Thirdly,suggestions are made on the key contents of the local legislation.
