Medical treatment difficulty troubles China’s development, seriously affecting the livelihood. As the drug problem is a very important part of medical treatment’s, its solution means much. On the one hand, a majority feel that medicines is beyond their affordability, on the other hand drug abuse is very common. Antibiotics are a certain kind of drug that should be cautious used, but they are also misused a lot. A variety of drug-resistant super-bacteria come into being. Antibiotics’sensibility is decreasing and many of them lose clinical usage. It deserves research that regulating irrational use of antibiotics with legislative technique.Chinese medical institutions heavily depend on income of the profits of drug sales, and by overusing antibiotics drives income on. And Chinese medical fee is paid after medical services, leaving a problem that medical service chargers induce demand. Although there are executive schemes aiming at anti-misusage of antibiotics, it appears only short-term effect which chronically diminishes. Besides, the management can not be applied to primary care institutions where the most common drug abuse places are. Health insurance institutions carry out poor management of the medical insurance fund, the way they using pamper doctors with the habits of misusing antibiotics and is difficult to completely change in a moment.Legal regulation of abuse of antibiotics is about the design of the entire health care system, and concentration on bills on anti-misusage antibiotics which is still insufficient.separating drug marketing from medical institution, changing the way medical services billed and paid, turning over the condition medical institutions induce demand, and perfecting antibiotics laws and regulations, strengthening the institutions of medical insurance management of drug expenditures, particularly antibiotics and expenditure management are all related.
