In maintaining human health, prolonging human life expectancy, antibiotics has played a big role. But violation of legal rights exist due to abuse of antibiotics, besides, it can also cause the bacteria forming speed, the medical curative effect reducing, threaten social stability. Therefor this article has this title to reduce the situation of abuse of antibiotics. While the number of the laws to regulate the abuse of antibiotics in China embodies is relatively small, relevant laws and regulations exist status is low, imperfect legislation, difficulty in actual execution, law enforcement officials have an inferior initiative etc. China's medical system is not sound, the lack of public medical and legal knowledge, safeguard the rights and interests of the pharmaceutical industry and practitioners lack of law are also the reasons of abuse of antibiotics abuse. Abuse of antibiotics in our country has not been supposed to pay attention to, the theoretical circle of law is still lack of research on the problem, has few significant research results, so the problems for further research is necessary. In this paper, using the theory of law, analysis by using the method of conbining theory with practice, comparing the legal regulation of the abuse of antibiotics in our country and foreign research present situation, to borrow relevant foreign experience, using my own social practice, aiming at the problems in this aspect in our country put forward the perfect relevant laws and improve the medical system, strengthen the law enforcement and supervision, and popularize knowledge of medicine, law and other regulations of abuse of antibiotics. Finally it is concluded that the legal regulation is efficient and feasible way to solve the problem of abuse of antibiotics.
