China-eu Legal Issues Of Technology Transfer Of Research Of New Energy Cooperation

Energy resources are signicant for human beings. As two important economies of the world, both China and EU are confronted with energy resoures shortage. Good coorperation on developing new energy resourses is an efficient way to solve the problem. The author of this essay starts from the energy resource situations of China and EU, new energy resource, Sino-EU coorperation on developing new energy resourses and Sino-EU energy resource laws and polices, then finds and analyses problems exsisting in technology transfer law system, finally forcus on barrier factors exsisting in Sino-EU new energy resource technology transfer as well as offers some helpful suggestions on promoting Sino-EU new energy resource technology transfer after an analysis of the barrier factors.There are four chapters in this essay.The first chapter discusses the energy resource situations of China and EU as well as the booming of new energy resourses industry. The first part analyses the energy resource situations of China and EU. The second part starts with traditional energy resourses and then turns to the introduction of new energy resourses, new energy resourses industry, new energy resourses policies and current situation of new energy resourses industry around the world.The second chapter introduces the laws and polices of China and EU on energy resourses and new energy resourses. The first part dicusses the the laws and polices of China on new energy resourses. The second part introduces several specific EU laws and polices on new energy resourses and EU’s energy foreign affairs strategy. The third part tells its readers China and EU’s international cooperation plan on new energy resourses, as well as the Sino-EU coorperation on new energy resourses.The third chapter focuses on the issue of Sino-EU new energy resource technology transfer. The first part introduces the concept, the content and the features of technology transfer. The second part anlyses laws and policies of technology transfer. The last part demonstrates Sino-EU new energy resource technology transfer with a real case.In the forth chapter, the author analyzes five main issues (intellectual property, monopoly of multinational companies, investment and trade policy, technical barrier and technology import and export administration) which affect Sino-EU new energy resource technology transfer in detail and then provides some practical and helpful advices on how to deal with these issues. The first chaper analyses Sino-EU new energy resource technology transfer from intellectual property angle. The second part focuses on technology monopoly of multinational companies. The third part focuses on Sino-EU investment and trade policy. The forth part investigates various EU technical barriers which might affect the new energy resource industry. The last part discusses the technology import and export administration issue.In the ending, the author believes China and EU should take the opportunity to promote the development of new energy resource industry since all conditions are satisfied. Besides, China should establish its own technology transfer law system as soon as possible.
