Answer To The Transfer Of Tacit Knowledge In Clean Energy Technologies With IPR

Developed countries are obliged to transfer clean technologies to developing countries in international convention, which are crucial for mitigation of climate change and needed by developing countries. However, it has little effective. Our nation as a developing countries are urgent to need clean technologies, because of serious environmental problem. But the crucial is the transfer of tacit knowledge in clean technologies. To respond to international convention, as well as improve the law of our country about the transfer of tacit knowledge in clean technologies. This paper will study it at IPR angle.At first, define clean energy, clean energy technology and tacit knowledge, etc; and discuss the in detail to all about tacit knowledge, including the philosophy background, the tacit knowledge theory composition, the psychology foundation and the philosophy significance; and present the importance of the transfer of tacit knowledge further. Then continue to introduce our nation about the IPRS protection of clean technologies with tacit knowledge transfer. This paper put forward suggestion about improving the protection of law from patent law, trade secret and anti-monopoly law perspective that is the transfer of tacit knowledge in clean technologies. At the same time, on base of comparing to the IPR regime of developed countries, the author will present our country about IPRS regime of clean technology, which is hoping to promote the transfer of clean technology?assimilate?digestion and utilize in our country.
