| This paper makes a multi-dimensional study on the complexity of competitive sports crime.In "competitive sports crime analysis "section, this paper firstly collates and analyzes the factions doctrine on the concept of crime in competitive sports,define the meaning of competitive sports crime with the criminology perspective,defines the scope of the study, and expresses the point that competitive sports crime, including criminal behavior and sports deviant that harmful to the society. Secondly, in the angle of the Criminal Law and Criminology, the comprehensive analyzes the basic characteristics of the competitive sports crime, in order to grasp the nature of competitive sports crime accurately. Finally, since competitive sports crime is complex systems, this paper in-depth analyzes the factors which cause competitive sports crime in the perspectives from sociology, economics and law.Based on an overall explanation of the phenomenon, cause fators of competitive sports crime,the present paper discusses how to control "deceitful match of ball","evil referee","violence between athletics","using of exciter", as well as competitive sports gambling behavior and other typical crime in the sports field of China.In the governance recommendations of "deceitful match of ball"and "evil referee",this paper comments that governance approaches should emphasized not only legal in nature, but also self-regulation in sport field, integrity of the internal supervision and punishment mechanism.In the governance recommendations of "violence between athletics", this article claimes that proper behavior of competitive sports should not be incriminating,and the importances of strengthenning the establishment conditions of proper behavior in competitive sports.Whether such acts have sinned, the discussion points out that it’s necessary to make a concrete analysis of concrete conditions.In the governance recommendations of "using of exciter", this article emphasizes that promote China’s anti-doping work should consider the factor of legal, education, technology. Firstly, strengthen sports ethics education, strengthen the supervision by public opinion; secondly, complete the legal system construction; finally, develop realted scientific technology.In the governance recommendations of competitive sports gambling behavior, this article emphasizes that the governance must be thorough, comprehensive. It is necessary to combine the education moral values and the force of the country; it is necessary to combine the legal means and internal oversight mechanisms of competitive sports; it is necessary to effective interface of the judiciary.In the course of discussion, this article holds that China should draw from other countries their mature mode of management on their athletes, referees, sports organizations and clubs, establish and develop our competitive sports management system so that we can standardize and restrict the behaviors of sports related people and organizations, thus to find concrete and effective path for governance of competitive sports crime, protect the career in competitive sports in China to be sustainable and healthy. |
