The mutual trust between the employee and the employer is the basis of laborrelations. From the view of the employee, the subordinate of the employee and thecorresponding employer expectations of the behavior of employee, and thus theemployee bear the duty of loyalty to safeguarding the legitimate rights and interests ofthe employers. Also, because the duty of loyalty involved the interests of employers, theinterests of employee and even the interests of third parties, and employee in violationof the duty of loyalty may be subject to employer discipline or dismissal, therefore it isnecessary to rationally define the scope of the employee duty of loyalty. This paper justchoose the perspective, on the basis of the basic theory of the comprehensive study ofthe definition, nature, content and legal consequences of the employee duty ofloyalty,throughout the general idea of respect for the employee’s main character,maintain a relationship of trust, and balance of interests,discussing the considerations ofthe employee duty of loyalty.Finally put forward proposals provides for our country’slegislation from three aspects which involves the principle,considerations, as well asthe legal consequences. It focuses on putting forward proposals provides for theconsiderations from three aspects which involves distinguishing between employee, thespatial and temporal scales, shall not exceed the employee’s significant legal interest, aswell as the balance of the employee’s duty of loyalty and citizen’s duty.
