China To Participate In The Un Human Rights Mechanisms And Effect Analysis

The U.N. human rights regime was constructed and developed since the World WarⅡ,with over60years’ development, the U.N. human rights regime becomes the mainform of the international human rights regime. With the U.N., the world’s biggest,most important and most authoritative intergovernmental organization as its carrier,the U.N. human rights regime has made a series of international conventions anddocuments; set human rights protecting institutions like the U.N. Commission onHuman Rights and the U.N. Human Rights council; hold conferences in frame ofhuman rights to provide different states a platform to contact and cooperate with eachother. With its long time efforts, a global human rights regime, which has explicitpurpose, principles, rules, measures and decision-making procedure has been set up,and it involves all fields of human society.Human rights concept can be found in China’s traditional thought, and tillmodern China, the spirit of human rights referencing western view of human rightsbegan to germinate, after the founding of the PRC, human rights view with Chinesecharacteristics was further developed but there are a lot of differences between Chinaand western countries in field of human rights, China has a conflicting emotion inwhether or how to take part in U.N. human rights regime. In one hand, human rightswas once thought to be a concept represent the western capitalist mode of productionand western values in China, China worried that human rights concept became theweapon of western ideological struggle, and too much emphasis on human rightswould be a treat to China’s sovereignty and territory; on the other hand, with thedevelopment of globalization, the importance of international institution becomesmore and more visible and the U.N. human rights regime plays an important role inglobal human rights protection, China began to realize that take part in the U.N.human rights regime with a more positive stance would bring China realistic interestsand positive effects.This paper attempts to summarize the way that China took part in the U.N.human rights regime since the founding of the PRC to analysis China’s foreignpolicies in different historical stages and under different domestic and internationalcircumstances; via exploring the construction, function and limitation of the U.N.human rights regime to analysis the necessity and inevitability of China’s taking partin the U.N. human rights regime. This paper would take international regime theory as an analysis framework to expound China’s diplomatic choice in new era and thepossible domestic and international effects.
