It is obvious to all that China’s rapid economic development has achieved tremendous success. However, along with people’s increasing awareness of health and environmental protection, issues of environmental protection have emerged. The group protest incidents caused by the public’s universal anxiety on the environment occur more frequently than ever. Correspondingly, the government, the NGOs, and the public all contribute to finding out effective ways to solve the environmental problems. Public participation plays an important part in constructing an environmental protection society as harmonious public participation in enviromental protection is the foundation of social harmony. Trends of worldwide environmental protection have penetrated deeply into the society, and many countries have endeavored to explore the most appropriate modes of public participation in enviromental protection. This paper starts from analyzing the status of the domestic public participation in enviromental protection, and discusses in details mainly around the following issues:Chapter1:The theoretical basis and the value analysis of public participation in enviromental protection. This chapter is divided into four parts. The first part generally defines the public participation in enviromental protection; the second part describes the relationship between the public participation and the environmental protection; the third part discusses the theoretical basis of public participation in enviromental protection in four aspects; Part IV analyzes the value of the public participation in enviromental protection in four aspects.Chapter2:The domestic status of the public participation in enviromental protection and the relative legal issues. This chapter is divided into two parts. The first part briefly introduces the current status in China; the second part sorts out the existing legal issues, which mainly involve the omission of public’s right to know, absence of public participation in enviromental protection caused by legislative defects, and insufficient modes of public participation in enviromental protection.Chapter3:Conceptions and suggestions on the promotion in establishing the legal system for the public participation in enviromental protection. The chapter is divided into four parts. The first part, it is recommended to strengthen the construction of environmental information disclosure system; the second part of the same recommendations to improve the hearing system of environmental impact assessment in China from the four aspects; the third part of the recommendations from the five areas to improve the environmental public interest litigation system, provide a legal basis for environmental protection and protection; The fourth part, stressed that play the role of NGO participation.
