With the deepening of the policy of reform and opening-up to the outside world and the perfection of the market economic system, the economic development of our country has made remarkable achievements. But we also have to face up to some new situations and problems such as the recession and officials "sea hot" phenomenon arising on the way towards tremendous successes.Officials "sea" phenomenon which has caused extensive attention of the whole society, is a double edged sword. It has the potential both to enhance and to affect the development of market economy. On the one hand, it can accelerate the flow of talent during the new period, while on the other hand, it may lead to unfair competition and breed invisible corruption. Faced with this issue, the Chinese government should focus its effort on regulating, monitoring and standardizing working behaviors by making relevant policies and laws so as to avoid its disadvantages.This paper tries to find out existing institutional deficiencies by summing up the employment restriction systems about civil servants employed after their resignation. Besides this, this thesis has made some brief introduction of the present systems abroad and put forward some new propositions to improve the post-employment restrictions system by comparing related regulations abroad and drawing upon some mature practices and successful experiences from other countries. The necessity of perfecting the present limited system is proposed in the first part by listing and summing up existing policies, laws and related regulations, and pointing out the existing institutional deficiencies while asserting its reasonable part simultaneously.The second part mainly introduces related regulations about civil servants’ post-employment restrictions of the United States, Britain, Canada, Japan and other countries by analyzing its specific features, so as to be clear about what to learn from foreign countries.The third part talks about the ways to perfect our country civil servants employed in post-employment restrictions system conception. This session is also the conclusion. On the basis of the comprehensive discussion of the first and the second part, this part will further synthesis the latest research results of domestic scholars, and put forward the concrete methods suitable for China’s national conditions by taking in some successful experiences from foreign countries. This system will be improved from the legislation, government functions and related systems. The author hopes that these tentative ideas will play a valuable role and contribute a bit to improving our country civil servants employed in post-employment restrictions system.
