Discussion On The System Of Government Information Publicity In China And Its Perfection

The administrative agencies control majority government information, but the information can not be understood by everyone. Many countries have created the system of disclosure of government information to facilitate the public aware of the necessary government information. It based on the basic theory of government information publicity.This paper disclosures theory from the perspective of people’s sovereignty and the right to know the government information. This paper analyses the existence question and the reasons of the government information publicity system in our country, and reference the government information publicity system in foreign countries, then put forward the countermeasures, such as setting up service idea and the idea of limited government, play he role of social public、hearing system and the system of taxpayer’s litigation.Specifically, described in four parts, the first part is an overview, discusses on the topics, research status, research methods and innovation. Such as:The disclosure of government information is not perfect in the existing legal system, information disclosure scope ambiguity, lack of effective supervision, safeguard and relief system.The reasons for these problems are the backward idea, the obstructive of the people of vested interest and the lack of supporting system. The third part is the relevant reference and contrast in oversea. This paper mainly in Sweden, the United States and Taiwan as the object, This paper gets the enlightenment:the publicity of government information codification, clear open range, the government information public controversies involved into the general administrative dispute settlement mechanism. The fourth part from the concept of innovation, legal system construction and concrete legal system construction three aspects put forward the improvement measures. In the legal system construction, advocate further clarify the constitutional right to know and information security, the formulation of a unified government information public law, and law system. The specific legal system construction includes normative publicity system, perfect the hearing system, the establishment of taxpayer’s litigation, and improve the news spokesman system.
