On Our Country’s Duty Crime Investigation System Of Special Measures To Construct

The duty crime is more and more intelligent, specialization and modernization, the traditional detection means and measures has been difficult to adapt to current duty crime investigation. Special investigation measures are indispensable to detect the duty crime.Although some department law of our country have already stipulated the use of technical reconnaissance measures, the new criminal procedural law amendment also formulated the "technical investigation measures" chapter, but these regulations are not comprehensive and specific, and lack of other special investigation measures. Any legal system establishment, all need a self improvement process. In this paper, we employ the empirical analysis, comparative analysis and other methods. According to the existing various defects of this system, this paper analyzes and discusses how to overcome these defects, and put forward some reform ideas and suggestions, based on the existing theoretical research results. And preliminary discussed how to protect human rights and prevent excessive use of the special investigation measures.This paper is divided into four chapters.The first chapter presents the concept, characteristic and types of the special duty crime investigation measures briefly analyzes the connotation, essence and characteristics of investigation measures. The second chapter expounds the provisions of international convention, and the current situation of duty crime in our country, further demonstrates the necessity of use special measures in duty crime investigation.The third chapter presents the special investigation measures legislation at home and abroad. Relevant laws in our country is relatively backward, the provisions of the technical investigation measures in the new criminal procedural law amendments also exists defects. This chapter mainly introduces and briefly analysis the mode and basic content of special investigation measures legislation abroad. The fourth chapter is for the construction of legislation system of duty crime special investigation measures. This chapter firstly reflects on and demonstrates some traditional concept and theoretical about duty crime special investigation measures, and then puts forward some reform ideas and suggestions for legal system of the duty crime special investigation measures.
