A Study On Protection Of Criminal Victims’ Rights

Looking back on the history of the development of human society, it is not difficult to find a phenomenon.That is the victim should have lawsuit right and safeguard mechanism when human society had crime.The level of protecting lawsuit right is not only the main content of safeguarding human rights, but also reflects civilization and justice in criminal action of a country directly.In recent years, with the continued transformation of Chinese society, the criminal judiciary system is taking place profound changes. in contrast to safeguarding the accused man’s human rights in the past, more and more researchers are beginning to focus on procedural rights of victims.We can research the problem of the criminal victim’s right protection from different perspectives. This article introduce the current situation about victim’s status, the deficiency in safeguard their rights and the provisions on protecting victims in the international community. There are several proposals about improving the victim’s rights system in Chinese criminal case. The innovation of this article is that:Firstly, revealing the limitations of the parties to the status of the victim, increasing the need for the victim the right to appeal.Secondly, with the phenomenon of crime and deepens the understanding of the development and protection of human rights movement, concerned about the plight of criminal victims, emphasis on criminal interests of the victims, the necessary economic compensation to the Criminal Victim, has become a major trend in the criminal legal developments in the world, China In recent years, regardless of the theoretical circles or judicial practice on victims of Crime compensation System were given more and more attention, This paper describes the need for the establishment of a national compensation system, the feasibility to improve the criminal victims to be compensated rights. Thirdly, the article elaborated the necessity of establishing aid system for victims. It is a way to improve the situation of ineffective protection and lack of relief for criminal victim’s legal rights and interests.Comparative experiences and practices of the international community, we should be recognized that there is a gap between china and others. But in our country, the victim was one step ahead and achieved the status of the litigants. If this is not blindly, at least it is unworthy of the name. Therefore, how to learn from and draw on advanced international experience to further improve and enrich our theory and practice of victim protection, is in front of us, is an important issue to be solved.
