A Tentative Research On The Flaws Of Primary Administration And The Resolutions

The flaws of administration is an important concept in administrative law. It is ofgreat significance for achieving legalization to prevent and reduce the administrativeflaws. As the state apparatus dealing with the people most of the time, basicgovernment and its departments should pay attention to administrative flaws whichcan be beneficial to the establishment of a sound system of administrative flaws.From the aspect of current socio-economic development, administration by law is theinevitable requirement of modern government. While there is lack of cleardefinition of Administrative flaws in the current law, and Administrative flaws is arealistic problem, which leads to different standards of the punishment ofadministrative flaws. And that is not helpful to the prevention and reduction ofadministrative flaws. the author analyses the administrative cases based on localgovernment and its departments in the past two years, and finds out the currentsituation, presents preliminary ideas for our administrative defective system design,and puts forwards some ideas about prevention and reduction of administrativedefective system from source.This article discusses as following structure:Introduction emphasizes the research significance from the two aspects of theoreticalstudy and practical significance, and determine the initial ideas for our administrativeflaws system and countermeasures to prevent and reduce the primary administrativeflaws from the source.The first chapter discriminates the concept of administrative flaws, and then throughthe analysis of administrative defect types, establishes a theoretical basis for theanalysis the basic administrative flaws. Meanwhile, through the analysis of the systemof extraterritorial administrative flaws, it provides a realistic reference foradministrative flaws system for initial idea below.Chapter II of this paper starts by the focus of the administrative departments of thegovernment and its work from the author who works in a district of the circumstancesof the case. By the statistical analysis and case analysis, and the losing administrative litigation, it briefly describes some common administrative flaws in local areascurrently.Based on basic sample analysis, and common administrative flaws in some local areas,in the third chapter, the author combines administrative flaws system in Germany,Japan and Taiwan, and presents the preliminary recommendations of ouradministrative flaws system, targeted at the prevention and reduction of basicadministrative flaws from the source, with the idea of strengthening basic governmentand administration. And at last, continue to promote the operation of theadministrative system, put forward relevant countermeasures started with goodinteraction between strengthening the basic administration and administrative trial.Starting from administrative cases from the sample area in nearly two years, the essayfinds high incidence of administrative flaws in some basic areas by the analysis of thelosing administrative cases, and propose a solution in the hope of playing a certainrole in the study of administrative flaws System and basic administrative flawsprevention and reduction.
