The Study On Administration By Law In Dongli District Including Current Situation Existing Problems And Relative Countermeasures

Local governments lie in the intermediate links of the administrative system in China, who are law executors. They implement administrative acts to administrative counterpart directly, and the Justice and practicality of law shall be reflected by their specific administrative acts. Whether local governments can implement administration by law, as the level of that, decides whether China can implement the basic strategy of ruling the country by law. Combined with current working emphasis of local government in exercising power according to law, this thesis discusses the significance that local governments exercise power according to law. This thesis also discusses situation of administration by law in Dongli District, Tianjin, China, and takes it as an example to find the problems for local governments to rule its area by law, then, analyzing problems and offering suggestions, improving the ability of local government in ruling its area by law. This thesis has five chapters: Chapter one is the introduction, which tells the research background, research thought, research content, research method and research significance in studying administration by law, and review of related researches. Chapter two mainly elaborates the basic theories about administration by law. Chapter three elaborates the accomplishment in the process of administration by law in Dongli, Tianjin, and analyzes some problems in such process, which are that there are some misunderstandings in basic concept of ruling by law, that there are some aspects needed improving in the executive decision-making mechanism, that the administration on administrative enforcing law needs improving, that administrative supervision system runs poorly, and the supervision degree is not enough. Chapter four analyzes the reasons why there are some problems for local government in the process of realizing administration by law, such as the thought of “ruling by man” affected some officials in government, lack of ability in administration by law, the serious impact on administration by law from interest, the faultiness in administrative system and barriers in supervision for administration by law. For the existing prominent problems for local government in realizing administration by law, Chapter five offers some suggestions and countermeasures in four aspects for governments, which are perfecting and improving ability in implementing law, executing law strictly, strengthening the supervision for administrative acts and strengthening the cultivation of law-enforcing team. I hope all what I have researched can offer some references in promoting administration in accordance with law.
