The Study On Prevention And Countermeasures Of Food And Drugs Safety Crimes

Nowadays, food and drugs security is an important and public issue faced by allgovernment throughout the word. The mad cow disease from abroad, domestic poisonoussteamed bread, melamine events, Xin Fu accidents and so on. All these show the severe foodand drug security situation. Western developed countries have formed a relatively maturemechanism dealing with food and drugs safety problem as they start early, pay attention tolegal system and make plenty of scientific research etc. while our country make food anddrugs security serious and one of the problems which require our government to resolveinstantly for we start late, invest less and in the period of transition as well as aspect reasons.This is the reality grounds for my writing. This paper consists of three parts.The first part inspects the gravity of food and drugs safety problem and analyzes themain types of food and drugs safety crime based on criminal law. From it the thesis found thefood and drugs safety crimes have features of diversified subjects, method variety andintellectualization, etc. then this thesis also study the difference between domestic andoverseas regulation system on food and drugs safety to find the defects in our regulation.The second part mainly analyze why the food and drug safety crime is that tough atpresent from the aspects of causes of crimes. The thesis explores it with two theories ofcriminology. One is from individual level and the other is from social. The former is rationalchoice theory from individual level reveals the benefit mechanism which impels theimplementation of food and drugs: criminal cost below the risk of crime. The cultural conflicttheory from the point of view of society crime: cultural conflict at present is the main reasonof crime in our country as well as the cause of food and drugs safety crime.The third part combining with the first two researching results, the thesis presentsmethods with respect to four aspects to deal with those criminal behaviors, posing threat tofood and drug safety, to improve law and increase punishment, to establish comprehensiveand effective supervisory and administrative mechanisms, to invest more scientifically andtechnically and to take advantage of supervisory power rooted in the media the public.
