The Research On Crime Prevention Issues Of Food Safety In China

With the development of socio-economic, quality of life that people require is getting higher and higher, food shortages worries gradually evolved into a panic on food safety issues. The economy develops rapidly, followed by the increase in food safety crimes. At present, China’s food safety problems are severe, food safety events occur frequently all over the country, the fake and shoddy food in the market is a serious threat to the consumers’ physical health and life safety. Crime prevention on food safety is the foundation of China’s rapid economic development, it relates to the interests of food consumers and social stability. Therefore, we should improve crime prevention mechanisms of food safety, and control the crime rate in the area of food safety from the source.First, this paper defines the relevant concepts of China’s food safety crime prevention; based on the law, use a multidisciplinary perspective to support food safety crime prevention related theory basis; and the theory of survive, the theory of harmonious society, and the theory of risk prevention and cost and benefits are all used to perfect this research. At the same time, clear food safety basic principles of crime prevention and research on the principle frame.Second, in consideration of current situation of food safety crime in China, this research analyzes the existing problems in China’s food safety crime prevention, including unclear regulations division of subject, inadequate access to food industry standards as well as administrative penalties. And it also has analyzed the causes of these problems.Third, in typical countries and regions in Europe, America and Asia’s experience of preventing food safety crime made objective analysis, summed up the perfect law and unified regulation, information transparency and public participation and responsibilities clear and whole process control accord with China’s national conditions, is worth learning in our country and draw lessons from the experience. By drawing on relevant experiences in food safety crime prevention of foreign countries, in order to realize the comprehensive protection of food safety, we should improve the food safety legal system with Chinese characteristics.Finally, this study targeted put forward the current difficulty of China’s food safety crime prevention; In other developed countries and developing countries, on the basis of relevant experience and lessons, combines the actual conditions of our country present stage, put forward from three aspects to perfect our food safety crime prevention mechanism suggestion. The first is constructing food safety prevention system of crime, including government-promoted, the oversight of social groups, social participation, social ethics construct, and strengthen supervision and management. The second is perfecting penalty settings, introducing the eligibility criminal and strengthening penalties criminal penalties on the field of food safety. The third is increasing job crime provisions of food safety regulators to fill legal loopholes and disadvantages of this stage.In recent years, although there was a lot of research on the food safety regulation in the educational circles, most discussion is carried out from the "Food Sanitation Law " and legal protection of food safety. Based on the concept of risk prevention, this article concerns the victims from the turn dangerous. Through building and improving the food safety crime prevention mechanism, we can solve the outstanding problems in the field of food and enhance its competitiveness, to make the food industry towards the road of sustainable development of our country.
