Study On Prevention And Control Of The Crime Of Endangering Food Safety On The Internet In China

The number of the crime of endangering food safety on the network is increasing,which not only gains the difficulty of combat,but also causes the problem food to spread through the network,thus increasing the harm to people’s health,economic development and social stability.Therefore,it is of great significance to investigate the prevention and control of the crime of endangering food safety on the network.This article progressively analyzes the problems of food safety,including analyzing the food crime phenomenon,summarizing the reasons of the crime and proposing the ways of crime prevention and control countermeasures.Through the collection and collation of judicial documents issued by the China Judgements Online from 2013 to 2017,the types and specific characteristics of crimes related to food safety are analyzed;and various crime reasons are expounded from several perspectives.Based on the overall investigation of the crime phenomenon and the causes of crime,targeted crime prevention and control countermeasures are put forward.Specifically,this paper conducts research on the crime of endangering food safety involved in the network through four parts:The first part includes the summary of the crime of endangering food safety on the network in China.This section outlines the concepts of food,food safety,and crimes of endangering food safety.It also collates the provisions of Administrative Law of China and Criminal Law of China on the crime of endangering food safety crimes on the network,and provides theoretical and legal bases for the analysis of the following texts.The second part shows the analysis of the main types and conditions of the crimes of the endangering food safety on the network in China.This section mainly focuses on the statistics of 128 cases from 2013 to 2017 published by the China Judgments Online.It analyzes the criminal models,crimes status,and characteristics of crimes on the network in China,and provides the basic facts for the analysis of reasons for food crimes and crime prevention and control.The third part analyzes the causes of the crime of endangering food safety on the Internet in China.This section reveals the reasons for the generation and widespread transmission of endangering food safety crimes on the network in China through different analyses,and further analyzes the loopholes in the governance process of endangering food safety crimes on the Internet currently.The fourth part provides the ways of prevention and control countermeasures of China’s network-related endangering food safety.This section combines China’s current situation,refers to the successful experience of foreign prevention of endangering food safety crimes on the network,and discusses the means of prevention and control of endangering food safety crime on the network in China from the perspectives of legislation,law enforcement,justice,and social participation.
