On The Legislation Of Eco-industrial Park In Regional Recycling Economy

In traditional economic activities, people tend to exploit the material and energy on the earth in high-intensity, and constantly emit a large number of pollutants and waste to the nature in the process of consumption, this extensive mode of economic growth which turn material and energy into trash to achieve social-economic growth of "quantity" is leading to China’s many natural resources in shortage and depletion of the state. It is just based on this background, the term of circular economy began to appear in China’s academia. Circular economy is a kind of development model that advocate continuously recycling material.《People’s Republic of China Recycling Economy Promotion Law》 issued in2008establish the development of recycling economy as a major strategy for national economic and social development. Many provinces issued regional recycling economic law to respond this strategy. As a main form of recycling economic development, Ecological industrial park undoubtedly is of great significance. The most obvious characteristics of ecological industrial park,compared with the traditional economic and technological development zone and the high-tech industry development zone, is that it’s guided by ecology industrial theory to imitate the natural ecological system of material circulation pattern, thus make different enterprise to share resources and products which means the waste of an enterprise emitted in the progress of production will be raw materials of the other enterprise, that will maximize the usage of resources. However, China’s current legislation of circular economy, no matter from the national level and local level, are only generally set provisions to establish ecological industrial park, but for the question of how to establish ecological industrial park and how to regulate the operation of Ecological Industrial Park is a lack of clear legal provisions. It is necessary to consummate the legislation of recycling economy on the sides of ecological industrial park legislation system, access mechanism, governance structure and legal responsibility measures.
