Researches On Industrial Structure Law In The View Of Circular Economy

Circular Economy is a type of ecological economy, which aims at high-efficiency utilization and recycling of resources. Its principal is reducing, reusing and recycling, with the characters of closed-cycle on materials and ranked using of energies. It functions in the mode of material cycle and energy flowing in natural ecological system. Thus, it is an effective mode to solve the conflicts among economic developments, environment and resources, and to achieve the goal of sustainable development.The Industrial Structure Law is a basic law of industrial restructuring and updating in a country and is an important part of Macro-control Law. There are broad sense and narrow sense of this concept. In broad sense, the Industrial Structure Law is any regulation formed by man-made policy-related change in a country. It contains both laws of policies on Industrial restructuring (mainly referred to the Industrial structure planning law and industrial structure improving law) and related part in laws which directly adjust Industrial structure not adjusted by industrial structure polices(which is referred as laws of supplementary measures), such as related regulations in Tax Law and Corporations Law. In narrow sense, the Industrial Structure Law is just mentioned to laws adjusting the Industrial structure, and laws of supplementary measures are not included.In the mode of Circular Economy, the Industrial restructure and updating in China has new character. In accordance with the development of Circular Economy, the Industrial Structure Law should be made and improved, which is the main point I want to discuss.The first part is outline of Circular Economy and Industrial Structure Law. In this part, I introduced briefly about the definition, principles and hierarchies of Circular Economy; and also I make a description of the definition, laws which consist of Industrial Structure Law. In addition, I analyze the relationship between Industrial Structure Law and industrial policies.In the second part, I do some research on the relevancy between the Circular Economy development and the legislation and improvement of Industrial Structure Law. By detailed discussion, I believe that there is an very close relationship between them, and through the legislation and improvement of Industrial Structure Law to promote the Circular Economy development is a necessary path.The third part is the research on the legislation of Industrial Structure Planning Law. In this part, I discussed the object of legislation, method of adjustment, evaluation mechanism and liability in respect to Industrial Structure Planning Law. The fourth part is the research on the legislation and improvement of Industrial Structure improvement Law. Industrial Structure improvement Law is consist of Law on Promoting Small and Medium-sized Enterprises, Law on Rejuvenation of Area Industrial Structure, Law on the Five Industries'Structural Improvement, etc.The fifth part is the research on and adjustment method of Industrial Structure Law. In this part, I introduced the main adjustment methods of this law, and as viewed form promoting the development of Circular Economy, I discussed these exercises of adjustment methods, such as tax preference, government subvention, government rewards, option-to-purchase of government, measures of import and export and policies on foreign investment, etc.
