On The Perfection Of Legal System Of Food Safety Risk Prevention In China

In recent years,food safety accidents have happened frequently,which seriously endangering human health.The principle of risk prevention,which was originated in the field of environmental protection,has been introduced into the field of food safety and played an important role in food safety supervision and protection of human health.The European Union,the United States,Japan and other countries emphasis on the application of the risk prevention principle in their food safety supervision,they also have established a series of food safety risk prevention system.However,China is still in the initial stage of food safety prevention system,although Article 3 of the newly revised Food Safety Law of 2015 stipulates that risk should be managed and prevented,follow-up provisions also provides food safety risk monitoring,risk assessment,and the relevant food safety risk prevention legal system,which reflects our attitude on the risk management and prevention,but did not directly use the principle of risk prevention,nor form a systematic and perfect food safety risk prevention legal system.Therefore,the study of food safety risk prevention legal system,with reference to foreign advanced experience for China's food safety risk prevention legal system to improve the recommendations,that has great significance for improving the level of food safety supervision in China and protect public health.This paper is divided into four parts to discuss,the first part introduces the overview about the risk prevention legal system,including the development of risk prevention principles and the application conditions,and make a comparison between risk prevention and damage prevention,but also analyzes the connotation and core of the legal system of food safety risk prevention,only accurately grasp the the connotation and core of food safety risk prevention legal system,can we do a further study and research of food safety risk prevention legal system.The second part introduces the current situation and existing problems of the legal system of food safety risk prevention in China,including the change of risk preventionconcept and the legal system related to risk prevention,and analyzes the existing problems of food safety risk prevention legal system in China.The third part analyzes the key points and difficulties in the construction of food safety risk prevention legal system in China,and introduces the legal system of food safety risk prevention in the EU,the United States and Japan,and seeks the experience through case analysis.The fourth part is based on the food safety risk prevention legal system of our country,with the reference about foreign advanced experience,aims to make recommendation to improve China's food safety risk prevention legal system.
