The risk forewarning legal system for food safety in China was establishedin2009in the Law of Food Safety. The establishment is helpful to effectively preventthe risk of food security, relieve the severe situation of food safety problems andprotect the right of life and health of citizens. However, the legal system started later,has some shortcomings and is still not complete. Deep analysis and systematic studyon legal system of early warning on food security are of great significance in theoryand practice.We know from the Law of Food Safety, the risk forewarning legal system for foodsafety is mainly consisted of risk detection, risk evaluation and early warninginformation publication on food security, according to the law of food safety.Therefore, based on the content of three aspects of the risk forewarning legal systemfor food safety, the key problem of the risk forewarning legal system for food safetywas pointed out as follows: some information of risk detection on food security wasmissing; food produce enterprises did not play their full role in the first place of riskdetection on food security; the appraisal institution of on food security risk was lackof independence; there is popular mistrust of the evaluating experts on food securityrisk; the early warning information on food security din not communicate with publicsufficiently before the publication; the content of the early warning information onfood security was irregular; the type of feedback of the early warning information onfood security was single. for above problems, some concrete advices of improve thelegal system of early warning on food security were pointed out based on risk analysistheory, risk society theory, the legal practices of early warning on food security risk inEuramerican countries and the analytical methods of jurisprudence.The concrete advices are as follows: the supervision departments shouldstrengthen cooperation to improve the collection of risk monitoring information;financial incentives should be offered to food produce enterprises; an independentworking mechanism of the appraisal institution of on food security risk should beestablished; evaluating specialist groups on food security risk should be generallyaccepted, open and transparent; the early warning information on food security shouldfully communicate with public before the publication; the content of the early warninginformation on food security should be standardized as earlier as possible; thefeedback approaches of the early warning information on food security should bediversification.
