The Impact Of Marine Culture On Marine Related Law-Making Process

The21st century has been considered as the ocean century. The ocean, which was originally considered as a kind of economic and convenient traffic means, today has become an important marine resources pool. The ocean is increasingly becoming the focus of national competition. Respectively, the research on marine culture and marine law-making is not perfect and scatters in many fields. In view of marine culture and marine law-making both at home and abroad, the research on the relationship both is still blank. This paper, taking Japan as an example, analyzes the marine culture, studies the impact of marine culture on marine law-making from five aspects to provide lessons for Chinese marine legislationThis paper is divided into three parts:The first part:this part will mainly discusses the definition of marine culture and several maine marine culture in the world. By discussing the different definitions of marine culture, there will be have a preliminary understanding of marine culture, finding out the marine culture definition which is suitable for this paper.The second part:this part mainly discusses the influence of Japane marine culture on marine legislation to find out the potential link between marine culture and marine legislation. The effect of marine culture on marine legislation will be mainly studied from ocean territory, marine resources, marine fishery, marine safety and marine environment.The third part:through the conclusion of second part, this part will study lessons for China marine legislation from marine territory, marine resources, marine fishery, marine security and marine environment, combining with our own marine culture characteristic.
