The Impact Of Marine Culture On Marine Environmental Law-Making Process

The new global legal order in relation to the marine environment is based on international conventions. It has valuable reference and significant feasibility, but the factors that really affect and restrict domestic application is not the "consensus" within the legal system, but lies in the "difference", namely the domestic marine culture. The marine environmental legislation is one of the most typical examples in Canada, a variety of legislation has been issued in recent years in which directly response to the international marine environmental conventions and have achieved favorable results. In this research, the relationship between domestic marine culture and application of international marine environmental conventions are probed. Some suggestions for the development and improvement of marine environmental legislation in China are proposed.This paper is divided into three parts.In the first part, the concepts and characteristics of international marine environmental conventions, marine culture and the national application of international marine environmental conventions are defined, and the factors that influence the relationship between the latter two concepts are summarized.The second part takes Canada as an example, starting from the level of psychological, consciousness and ideology, then analysis how marine culture impacts the application of international marine environmental conventions at the domestic level and vise visa.Based on the conclusion drawn in the second part, combined with the characteristics of marine culture in China, the last part put forward the proposal for the marine environmental legislation in China.
