The ocean is the hope of the21st century, which has a significant impact on economy, politics, security and other aspects of the society. Many countries have developed their own marine development plans and have defined the development perspective of the sea, and even to raise them to the national strategic level. The national maritime culture was formed in the marine process of cognition, development and utilization, meanwhile, the fullness and the development of maritime culture affects the national ocean processes. As one part of the maritime culture, marine law-making is influenced by the national maritime culture. An enhanced ocean law system, as one of the important ways to safeguard national maritime rights and interests, is getting ocean countries more and more attention. Such as the United States, Australia, Canada and our neighbor Japan each has its own characteristics in terms of marine related legislation. The research on maritime culture and marine law-making is not perfect. This article, taking United States as an example, studies the impact of maritime culture on marine law-making through four aspects which include marine resources (not including fishery), marine fishery resources, shipping and the marine environment, and then reference refer to China’s marine related legislation.Part I:This section is the foreword of the paper, which includes writing background, the current study of maritime culture and marine related legislation, writing content and innovation.Part II:This section discusses maritime culture briefly in order to form a preliminary understanding of maritime culture. Then this paper discusses "sea power theory" which is one important part of maritime culture in the United States and points out the impact of United States maritime culture on the marine related legislation mainly in four fields, namely, marine resources (not including fisheries), marine fishery resources, shipping and the marine environment.Part III:Through the conclusion of second part, this part will provide reference for China’s marine related legislation from marine resources, marine fishery, shipping and the marine environment, combining with our own maritime culture characteristic.Part Ⅳ:This section is a summary of the thesis, which deepens reader’s understanding and feelings. At the same time, the author expresses hope for China’s marine related legislation work in the21st century.
