Research On The Treatment Of Foreign Investment In Kazakhstan

The treatment of foreign investment is one of the most important legal problemsin the field of international investment. Both in the theory of International Laws andin the practice of international investment, it has been highly emphasized and rathercontroversial, especially in the theory of International Investment Laws. As it is notonly directly related to the rights and obligations of international investors but alsothe interests between the home countries and the host countries, the treatment offoreign investment naturally becomes the focus of interests and the intersection ofadjustment between the reciprocal parties.Kazakhstan borders on China, its natural resources are so rich that it attract alarge number of foreign investors, including Chinese investors. In different historicalperiods, Kazakhstan successively promulgated and revised the laws and regulationson the treatment of investment. Then the policies of investment treatment have beenchanged and the domestic investment environment has objectively been affected.Therefore, on the basis of the theory of investment treatment in the InternationalInvestment Laws, and according to the investment legal system of Kazakhstan, thisarticle combines with the background of Kazakhstan’s application for WTO accessionand mainly attempts to research the legislation and the concrete practice ofKazakhstan`s national treatment (including the sub national treatment), themost-favored-nation-treatment and the preferential measures, at the same time, themajor changes and influences on them. Thus the article presents the countermeasuresand suggestions about the investment treatment for Chinese enterprises so that theycan be known well and benefit from the preferential policies of the investmenttreatment, and avoid the legal risk of investment treatment when they invest intoKazakhstan.
