Informed consent principle is not only the foundation and core of modern relationship between doctors and patients, and is the maintenance of patient rights and dignity, the improvement of medical personnel and patients, alleviate the relationship between medical staff and patients of the key contradiction. Informed consent principle as a basic principle to solve the medical dispute in the medical field, but also a conducive to the realization of the important principles of medical purposes, which has the guidance function to justify our medical behavior.The first chapter mainly introduces the medical "informed consent" the historical background and introduction of relevant cases, mainly from the medical "informed consent" generation, development and present situation of angle, proposed the introduction and the problems of relevant cases.The second chapter a legal analysis of the disputed issues, legal issues in dispute in terms of patient informed consent, the consent of the patient, the medical content of the informed patient understanding of medical content as well as medical informed consent exceptions.The third chapter discusses China’s informed consent legislation, legal thinking and legal advice. Legislation of informed consent law is too simple, the implementation is poor; provision of medical terminology fuzzy concept; informed consent right of special provisions exist legal blank; patient informed consent right protection scope is very small; not consistent with law and so on, and puts forward some legal suggestions.The fourth chapter focuses on the problems of China’s informed consent system, the relevant legislative proposals. Focus distinguish the difference between the patient’s commitment to medical consent, the specification of the relevant legal concepts. Proposed standardized and unified China’s current legal system, to fill the egal void.
