Research On The Legalization Of Partner Assistance

The partner assistance is a policy with Chinese characteristics,as early as1979it was officially proposed by CPC Central to support the development of ethnic minority areas. So far30years of partner assistance development process, has made remarkable achievements in balancing economic disparities between regions and ethnic minority areas to maintain long-term stability. But with the the partner assistance policy to carry out in-depth, its disadvantages are also increasingly prominent. The partner assistance process is often accompanied with the non-institutionalized, non-standardized criticism, scholars began its operation and development trend of a variety of concerns. Running partner assistance to rely on a central authority, administrative directives inevitably with a planned economy, ignoring the role of market mechanisms, which can not do the long-term, unified, scientific planning.The expansion of Administrative power in partner assistance can easily create rent-seeking corruption, affecting the process of the rule of law in China.Under the circumstance of Tax Decentralization exist insufficient, the financial transfer payment system in need of development stage bluntly proposed the establishment of horizontal fiscal transfer payment system is not appropriate. Therefore, I propose to explore the partner assistance under the budget law perspective."Budget Law" Article31set aside necessary funds to assist the developing autonomous areas, old revolutionary base areas, remote, poverty-stricken areas and the budget law Article32provisions of the reserve fund will be the breakthrough of the legalization of partner assistance,it can regulate its substantial financial funds, the transfer of materials, audit, assessment, monitoring and other issues.The paper is divided into four sections to discusses. First is the basic theory of legalization of partner assistance, including the partner assistance to the history, concepts determined,characteristics, meaning of the legalization of partner assistance and the legitimacy and feasibility of partner assistance; followed by a detailed description of the main problems in the partner assistance, such as over-reliance central authority, inaccurate positioning of government functions, starting with the uncertainty, long conductor is serious, the lack of an environmental impact assessment, incentives, monitoring system is not perfect and so on; once again I will be analyzing the partner assistance problems under the budget law perspective including:financial resources, powers serious asymmetry, the Budget Law to soften the constraints on government behavior, contingencies and other issues play a limited role, and finally put forward the path and countermeasures of the legalization of the partner assistance. The third, fourth part is the focus of the article.
