Geological survey is a kind of fundamental and proactive works contribute tonational economic and social development. Now geological survey has play anincreasingly important role in the aspect of supporting the development of miningindustry with the China’s accelerated process of economic development. But, due tothe inkling of legal nature on geological exploration results and the controversy ofdefinition on contents of rights and interests, the subjects who were engaged ingeological survey directly got some negative effects. So that the industrialdevelopment of geological survey has been slow down. It is necessary to discuss thelegal attribute and rights and interests of Geological survey achievement.The study focus on legal attribute and rights and interests of geological surveyachievement based on the concept and legislation of geological survey and thecontention about it.According to the legal provision of geological survey in china, the concept andscope has been defined, who also has been extensive researched in academic world.We consider that geological survey achievement is a kind of intangible propertywhich acquired through geologist ‘s works by investigate the Strata, geomorphic,mineral and hydrology. Geological survey is a kind of intelligence public welfareworks which’s results have great value. Legally, it is an intangible and creativeproperty which is the object of intellectual property. Geological survey results aremade up of a variety of legal rights and protected by Intellectual Property Law.Moreover, the works of geological survey results are protected by Copyright Law andthe discoveries of it shall be entitled to the right of discovery and science andtechnology achievements.
