The trade union as the representative and maintainer of employee benefits, bear the basic responsibility of the maintenance worker legitimate rights and interests. Trade union’s right-safeguarding objects include all the workers whose main income are the salaries, but in reality we tend to take the legitimate rights are violated as the vulnerable groups; Trade union’s right-safeguarding contents include the worker’s labor employment rights, the right to labor remuneration, political democracy, and other related labor rights. However, for a long time in Shandong province, trade union’s safeguarding rights function is severely limited, Combined with the power imbalance labor and capital, union workers lack rights protection experience, when the worker’s legitimate rights and interests are violated, trade unions are often difficult to Perform its right-safeguarding responsibilities according to law, and get into troubles. In recent years, Shandong province is facing in the field of labor relationship are becoming more complex, enterprise violates the rights and interests of workers caused by labor disputes are non the rise, the majority of workers urgently require unions to better safeguard their legitimate rights and interests, The party and the government also want trade unions to play a better role in the safeguarding workers’rights and lead the broad masses of workers to unite closely around the party. Therefore, research on the problems of trade union’s right-safeguarding is of extremely important theory significance and practical significance to ease the current tense situation of labor relations and to maintain social harmony and stability.This paper analyzes the trade union’s safeguarding function from five aspects. The first part introduces the background and significance of this topic and the research status in China and abroad on trade union’safeguarding.The second part introduces the trade union right-safeguarding function is of the historical inevitability, the development of Chinese trade union right-safeguarding, legal basis and main features. The third part introduces the basic situation of Shandong trade union, objects and contents, Shandong province trade union’s work practice and effect etc.. The fourth part elaborates the trade union of Shandong province facing difficulties, and deeply analyzes the reasons for the weakness of trade union from five aspects:lack the legal protection, lack public support,lack independence, the right-safeguarding mechanism is not perfect, trade union’s self-construction problems, furthermore, deeply analyzing the causes of difficulties in trade union’s right-safeguarding. The fifth part is proposed to strengthen the trade union’s right-safeguarding function from six aspects in view of the difficulties and reasons mentioned above:strengthen the legal security, strengthen the workers’support, strengthen the independence, strengthen trade union’s right-safeguarding mechanism, strengthen Trade union’s own construction, to build the characteristic right-safeguarding brand of Shandong trade union. So I completed the research goal of this paper.The innovation:Making a detailed discussion of trade union’s right-safeguarding practice in Shandong province, and based on the deeply analysis of difficulties and reasons of Shandong trade union’s right-safeguarding, putting forward some related countermeasures to strengthen trade union right-safeguarding in Shandong province.
