On The Network Of Civil Law To Protect Virtual Property

With the rapid development of science and technology, we have already entered into the era of national networks, the use of computers has deeply gone into all aspects of people’s lives,so as to people’s lives, learning,and it also had a tremendous impact on enterprise development and social progress. In recent years, the Chinese Ministry of Information Industry actively carry out the "village phone","township access to the Internet" and other towns spread of information technology to promote the project, the number of China’s rural netizens fold increase exponentially, coupled with the popularity of broadband, network speed improved, exciting online content and services increases, the mobile operators actively promote and3G technology widely used, people are able to maximize the realization of wireless networking anywhere. Internet, entertainment, information and communication function has been further strengthened by the people, and people make their action from the previous use of the network that simply brows information to more complex and colorful activities such as online games, online TV, online shopping, e-banking, e-commerce. However with virtual property frequently appear in people’s daily life, such infringement disputes abound. However, so far our country has not make an accurate definition of virtual property, the hysteresis of law result in a series of virtual property infringed upon the legitimate interests of Internet users that are not properly protected by law. The rapid development of network economy urgently need to recognize the legal status of virtual property, use the clear legal provisions to resolve such disputes, so as to ensure that the network industry in the development of a healthy track, and effectively protect users who have virtual property disputes get legal remedies.This article refer to many domestic academic point of view, combined with the domestic judicial practice of China, and learn from of the relevant legal provisions of other countries and regions, the following five parts of the network virtual property were discussed in detail. The first part, a brief introduction of the network virtual property disputes in a typical case, the judge dealing with the case together with an indication of the views put forward a series of issues discussed below, will commence shortly. The second part describes the state of the network virtual property concepts, characteristics, nature and the legal nature of the property in details. The third part introduces the virtual property of the conservation status of the network and the need to be protected. The fourth section describes the protection of virtual property in some foreign countries such as Hong Kong and Taiwan and the implications for China. The fifth part introduces civil legal advice of the perfect virtual property protection. This section includes the construction of civil legal system and specific recommendations.
